Terms of Service

These Terms of Service ("Terms") govern your use of DCareTree — the website-building and business-management platform for childcare providers available at dcaretree.com and on customer subdomains. By creating an account or using the service you agree to these Terms.
1. Your account
- You must be at least 18 years old and provide accurate information.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- One account may operate one daycare website unless otherwise agreed.
2. Your content & responsibilities
You retain ownership of everything you publish — photos, text, business information, and the records you keep about families. You grant us the limited license needed to host and display that content in order to run your website and dashboard. You are responsible for:
- Having parental consent before publishing photos of children or storing family information.
- Complying with the childcare licensing laws and record-keeping rules of your state.
- The accuracy of information on your website, including tuition rates and program details.
- Not uploading unlawful, infringing, or harmful content.
We may suspend or remove content or accounts that violate these Terms or applicable law.
3. Plans, billing & cancellation
- Paid plans are billed monthly in advance through Stripe and renew automatically until canceled.
- You can upgrade, downgrade, or cancel anytime from your dashboard; downgrades and cancellations take effect at the end of the billing period.
- If a renewal payment fails, we retry it; if it continues to fail, your account moves to the Free plan and your website remains online with Free-plan features.
- Fees are non-refundable except where required by law or offered at our discretion.
- Prices may change with at least 30 days' notice.
4. Parent Portal
Parents access the portal at the invitation of their daycare. The information shown there — attendance, invoices, reports, messages — is created and controlled by the daycare. DCareTree is not a party to the relationship between a daycare and the families it serves, including tuition obligations between them.
5. Acceptable use
You agree not to misuse the service, including by:
- attempting to access other customers' data or probe our security;
- using the platform to send spam or unlawful communications;
- reselling the service or misrepresenting your affiliation with DCareTree;
- interfering with the operation or performance of the platform.
6. Service availability & changes
We work hard to keep DCareTree fast and available, but the service is provided "as is" without warranties of uninterrupted operation. We may add, change, or retire features; if we discontinue the service entirely we will give you reasonable notice and a way to export your data.
7. Limitation of liability
To the maximum extent permitted by law, DCareTree will not be liable for indirect, incidental, special, or consequential damages, or loss of profits, revenue, or data. Our total liability for any claim is limited to the amounts you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
8. Termination
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, create risk for other users or children, or fail to pay. On termination, your website goes offline and your data is deleted per our Privacy Policy.
9. General
These Terms are governed by the laws of the United States and the state in which DCareTree is organized, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest remain in effect. We may update these Terms; material changes will be announced in the dashboard or by email, and continued use constitutes acceptance.
